Terms of Use
Please read our Terms and Conditions (Terms) carefully as these Terms constitute our legal contract with you. By booking, and/or participating in any session or activity provided by Blue Ocean Waves, you are confirming you have read the Terms and agree to be bound by them. Please also refer back to these Terms from time to time as they may change and we reserve the right to do so.
In these Terms:
we, us, our means Blue Ocean Waves. We provide all sessions and activities subject to these Terms; and
you, your, yours means you, the customer.
Data Protection
The nature of our business and the provision by us of sessions and activities to you means that we will collect and process certain of your personal data from time to time. We will only do so in accordance with our Privacy Policy.
Our Session and Activities
Many of our activities involve movement and physical activity, which some may find strenuous. It is your responsibility to seek medical advice before attending or participating in any session or activity we provide, including online.
You understand that you are voluntarily participating in sessions or activities we provide and agree not to hold us responsible for any injury or property damage that you may suffer as a result of your attendance or participation.
For your own safety and the safety of others we rely on you participating in our sessions and activities in the intended manner and your acceptance of these Terms constitutes your confirmation that you will do so, and that you will comply with our reasonable instructions in relation to your attendance or participation.
Our sessions and activities, including online, is not intended to be, and is not, medical advice or any other form of advice and must not be relied upon as such. Any reliance you may place on session content is at your own risk.
Where possible we will endeavour to advise customers upon request as to appropriate class or activities that we provide but we cannot be held responsible for incorrect or unsatisfactory advice. It remains your responsibility to choose the appropriate class or activity you wish to attend.
You are not required to participate in any of the routines or activities we deliver during a session or activity, including online, and may stop at any time. If you experience discomfort, pain, dizziness, nausea, or any other symptoms during your participation, you must stop immediately and seek medical assistance.
When participating in online activities, it is your responsibility to ensure you are wearing comfortable clothes that you can move freely in, that you have a clear floor space free of hazards, and that your device is secured in position so that you can safely follow online content.
Unless accessing session content or to support your participation, the use of mobile phones, or other electronic devices during any session or activity is not permitted.
All activities and instructors are subject to change from time to time, even after you have booked. We will let you know about any changes as soon as we can.
In participating in any of our sessions or activities, you agree to comply with any additional rules we may make known to you from time to time, including how you may use any venue or location, including online, where our sessions and activities takes place, and your conduct whilst doing so.
Filming or photography of any session or activity is not permitted. We may, from time to time, and with your consent, film or photograph a session or activity for promotional and operational purposes.
Access to our sessions and activities, and facilities is at our discretion and we reserve the right to refuse you access to any of the same, or to suspend or otherwise terminate your access if we consider that you are in breach of these Terms, or your behaviour is inappropriate, aggressive, rude, threatening or otherwise damaging to customers, volunteers, team members, or our reputation more generally. You will not be entitled to any refunds for paid services whatsoever under such circumstances.
Our online activities are intended for use by those who can access them from within the United Kingdom. If you choose to access our online activities from locations outside the United Kingdom, you are responsible for compliance with local laws.
Lateness Policy
We operate a policy which prevents you from taking part in a session or activity if you are more than 5 minutes late. This policy is in place to prevent injury and to be mindful of the class leader and other participants. You will not be refunded for any paid session or activity you are unable to attend because you are late.
In the event that we cancel a session or activity that you have booked, we will make reasonable efforts to contact you by email or telephone to let you know. Where available, will offer you the option of being transferred to another equivalent session or activity at an alternative date and time or provide a refund for any paid session or activity that has been cancelled.
